Minnesota DWI (Driving While Intoxicated) laws state that it is a crime to drive, operate, or be in physical control of any motor vehicle when the person in under the influence of alcohol, controlled substances, or a hazardous substance that affects the nervous system, brain or muscles of the person. If the driver is under the influence he will be charged with a criminal DWI offense. If the alcohol concentration of the violator is greater than .08 or if he refuses to take the chemical test then the accused can also be subjected to DWI charges.

Fourth degree DWI (misdemeanor): First time violation of DWI law within the past ten years and absence of any aggravating factors.

Third degree DWI (gross misdemeanor): Violation of the DWI law along with a single aggravating factor.

Second degree DWI (gross misdemeanor): Violation of DWI law along with two or more aggravating factors.

First Degree DWI (Felony DWI): A fourth violation of Minnesota’s DWI laws within ten years of the first is charged as a felony DWI. Further, once an offender has been convicted of a felony DWI or felony Criminal Vehicular Operation or Homicide (CVO or CVH) any subsequent DWI offense, regardless of the passage of time, is charged as a felony DWI.

Aggravating offenses in Minnesota include having a blood alcohol concentration of .20 or greater, the presentence of a child in the vehicle, refusing to submit to chemical testing, and each prior offense within the prior ten years.

DWI charges are strict and can lead to extensive penalties. Penalties vary with the degree of the crime. The maximum fine can range from $1,000 to $14,000. Maximum incarceration varies from 90 days to seven years depending upon the degree of the DWI offense.
