License Suspension Period in Minnesota

The license revocation period varies with the degree of the offense charged. The revocation period for a first time low-test DWI offense is 90 days and it is 180 days for a second low-test DWI offense which occurred within ten years of the initial violation. The revocation period is 1 year for a third time offense within ten years and 2 years for a fourth time offense. Depending on the offense, the revocation periods will increase and possibly double if you are under 21 years old or if the blood alcohol concentration is above .20 percent. Further, test refusal even for a first time offender will result in a one year revocation. License revocations also vary based upon the timing of prior offenses and the number alcohol-related offenses that the driver has in their lifetime. It is best to consult with a skilled attorney at Caplan & Tamburino Law Firm to discuss the duration of your license revocation.

License Suspension & Obtaining A Work Permit

To obtain a limited license (a.k.a. “work permit”) which allows you to drive to work and other limited activities after a license revocation, there will be a period of time during which you can not drive. The revocation periods depends primarily on the degree of the charges brought against you. For a first offense in a lifetime with an alcohol concentration below .20 percent the revocation period is 15 days before you may apply for a work permit. But if it is your second offense within ten years you have to wait for three months to apply for a work permit. These waiting periods may increase based upon your record, the facts in your case, and the test itself. Therefore, it is important to have the guidance of an experienced DWI lawyer to help you understand and navigate the proceedings and rules.

Reinstatement Fee and Driver’s License Test

To reinstate your license after the revocation period, one needs to pay a reinstatement fee of $680.00 plus fees, pass a written driver’s license test with questions concentrating on alcohol consumption, and obtain the approval of a License Evaluator with the Department of Public Safety.
