Felony DWI Penalties

A felony DWI carries a number of penalties which will affect you for the rest of your life.

You face up to 7 years in prison and/or $14,000.00 in fines;

You face a mandatory minimum penalty of 3 years in prison. This penalty may be waived only when a person submits to a long-term monitoring program that includes treatment, abstinence, and years of alcohol monitoring;

Your sentence will remain a felony and not be subject to any plea negotiations that allows a felony sentence to be reduced to a misdemeanor after a period of time;

If you’re sent to prison, you must complete 5 years of conditional release upon conclusion of your prison sentence. This release will include treatment and alcohol monitoring;

You will lose your driver’s license privilege for a minimum of two years but most likely up to 4 years;

Your vehicle will be forfeited, i.e., permanently taken from you; and

If you ever do receive your driver’s license back at anytime in the future, it will be an alcohol restricted (B-Card) license, wherein ANY use of alcohol (regardless of whether the use is driving related) will violate your license.

Criminal Vehicular Operation (CVO)

This charge involves a person who is driving a vehicle while under the influence of alcohol and/or drugs and causes an accident that injures or kills someone. This is a very serious crime.

If a person is convicted of a CVO that involves injury to another person, he/she will receive significant jail time and a lengthy driver’s license revocation period, even if they’ve never had a prior DWI or alcohol related offense.

If a person is convicted of a CVO that involves the death of another person, he/she will receive a 4 year prison sentence under the Minnesota Sentencing Guidelines, even if they’ve never had a prior DWI or alcohol related offense.
